Will of John H. Lowe Sr.
John H. Lowe Sr., died in 1863. He left a life-estate to his daughter Eliza Lowe. This document dated 1902 is the settlement of John's estate after the death of Eliza.
State of Georgia, County of Clarke
To the Honorable S. B. Wingfield, Ordinary of said County:
A. H. Morton, respectfully shows:
1st. That on the first Monday in May 1902, he was duly appointed, by your Honor, as Administrator "De bonis non" with the Will annexed, on the Estate of John H. Lowe Sr., deceased,
2nd. That the said appointment was made for the purpose of winding up the unadministered portion of said estate, contained in Items 10 & 17 of the Will of said John H. Lowe Sr., Testator, consisting of Four hundred & sixteen acres of land, more or less, lying in formerly Clarke but now the County of Oconee, Ga. That the Will of said Testator is on record in the Ordinary's office of Clarke County, Ga.
3rd. That, by the terms of said will contained in Items 10 & 17 the said Testator gave and bequeath said land to his daughter ELIZA LOWE, for and during her natural life, and at her death to be sold and the proceeds equally divided among all his Children, including the Children of his deceased daughters ELLEN STILLMAN and SALLIE DURHAM, the Children of his deceased daughters to received in said division the share that their mother would be entitled if living.
4th That at the time of the execution of said will and at the time of the death of said Testator he had living and surviving him SEVEN (7) CHILDREN, to wit: THOMAS F. LOWE; JAMES B. LOWE; JOHN H. LOWE JR.; WILLIAM T. LOWE; ISAAC LOWE; Mrs. NANCY MORTON and Mrs. EUDOCIA HARRIS. ELLEN STILLMAN one of his deceased daughters had living at the death of said Testator two Children, to wit; LEONIDAS and JOHN STILLMAN-The other deceased daughter SALLIE DURHAM had living at the death of said testator and who are still living Three Children, to wit; Dr. W. M. DURHAM of Fulton Co., Ga, Dr. JOHN L. DURHAM of Green County, Ga. And Mrs. KITTIE SMITH of Oglethorpe County, Ga.
5TH That one of the Children of said Testator, WILLIAM T. LOWE is still living and resides in Oglethorpe County, Ga.
6th That Mrs. EUDOCIA HARRIS another one of the children of said Testator is still living and resides in Brooks County, Ga.
7th That the other five children of said Testator, to wit: THOMAS F. LOWE; JAMES B. LOWE; JOHN H. LOWE JR.; ISAAC LOWE; and Mrs. NANCY MORTON died after the death of said Testator and before the death of ELIZA LOWE the life tenant,
8th That, THOMAS F. LOWE left at his death as his sole heir his Wife Mrs. MARTHA LOWE who died after the death of the life tenant, and whose estate is represented by Miss MARY FIELDING of Morgan County Ga., as Administratrix.
9th That, JOHN H. LOWE left at his death as his heirs who are now living Four Children, to wit; JAMES B. LOWE & JOHN E. LOWE of Walton County, Ga., Mrs. KITTIE JACKSON of Clarke County, Ga., and Mrs. EUDOCIA HARDIGREE of the County of Jackson, Ga.
10th That JAMES B. LOWE left at his death as his heirs and who are now living Two Children, to wit; Mrs. C.F. GEORGE and Mrs. S. L. HIGH of Morgan Co.
11th That ISAAC LOWE left at his death as his heirs his Wife Mrs. E. C. LOWE of Clarke Co. Ga. And Four children, to wit, Mrs. SALLIE PRICE of Oconee County, Ga. Mrs. KATIE PRICE; Mrs. MATTIE HERINGTON of Clarke County Ga. And WALTER LOWE who died after the death of his father, and left as his heir his wife Mrs. WALTER LOWE of South Carolina.
12th That, Mrs. NANCY MORTON left at her death as her heirs and who are now living, Miss ELIZA MORTON; Mrs. KATHERINE JACKSON and A. H. MORTON of Oconee County, Ga.
13th That, LEONIDAS STILLMAN deceased, left as his heirs who are now living his Wife Mrs. M. E. STILLMAN of Fulton, County, Ga. And Five Children, to wit; G. E. STILLMAN; LEONA STILLMAN; KING STILLMAN and LEO STILLMAN of Fulton Co., Ga., and LOWE STILLMAN of Hartly County, Texas.
JOHN STILLMAN deceased, left as his heirs and who are now living his Wife Mrs. E. V. STILLMAN of Octibbeha County, Miss. and four children, to wit; J. H. STILLMAN, of Octibbeha County Missippi; C. L. STILLMAN of Chatham County Ga. Mrs. NANIE CUNNINGHAM of Lauderdale County, Missippi; and Mrs. JULIA V. JACKSON of Oconee County, Ga.
14th Petitioner further shows: That the said WILLIAM T. LOWE; MRS. EUDOCIA HARRIS; The heirs of JOHN H. LOWE; deceased, The heirs of THOMAS F. LOWE, deceased; The heirs of James B. Lowe deceased; The Heirs of ISAAC LOWE, deceased; The heirs of Mrs. NANCY MORTON, deceased; The heirs of Mrs. SALLIE DURHAM, deceased; and the heirs of LEONIDAS and JOHN STILLMAN, deceased are the distributes of the estate of JOHN H. LOWE SR. deceased.
