Will of Henry Huff

Recorded November 9, 1843, in Book C, Folios 2, p.28.29.30 in Clarke County, Georgia Courthouse

In the name of God, Amen. I Henry Huff of Clarke County, Georgia, being of sound and disposing mind and memory, but in feeble health and conscious that the hour of my dissolution is not far distant, make, ordain, publish and declare this to be my last Will and Testament, hereby revoking all former Wills by me heretofore made.

I commend my soul to God who gave it and my body to the dust, to be buried in a decent manner.

Item lst. I wish out of my property all my just debts paid.

Item 2nd. For the love and affection I have for my son John Huff, I loan to him my negro boy named Edmond so long as he (my said son John Huff) may live, and after his death to return to surviving children, unless he should have an heir or heirs born to him, in that event to go to them.

Item 3rd. I give and bequeath to Thomas E. Williamson as trustee and trust for the children of my son Littleberry Huff now in life and those that may hereafter be born to him, one negro boy named Lewis, and sixty-four acres of land in said County whereon said Littleberry now lives, for their use, benefit and support to be used and enjoyed by them forever, free from and unsubjected to the debts of their father the said Littleberry Huff.

Item 4th. I also give and bequeath to Thomas E. Wiliamson as trustee and in trust for the children of my son Leroy Huff, in life and hereafter born, one negro boy Anderson, upon the same conditions and under the same trusts as the foregoing last bequest.

Item 5th. I also give and bequeath to Thomas E. Williamson as trustee and in trust for the children of my daughter Lona Durham now in life and hereafter born saving and excepting Matilda J. Durham one negro woman named Charlotte and her youngest child, now unnamed, under the same trusts and upon the conditions of the two last bequests.

Item 6th. I also give and bequeath unto Thomas E. Williamson as trustee and in trust, for the use of my Granddaughter Matilda J. Durham, one negro girl named Eliza and her increase free from the debts and contracts if any husband to whom she may be married for her benefit and the benefit of her children should she ever have any.

Item 7th. I also give and bequeath to Thomas E. Williamson as trustee and in trust for my daughter Lydia Jones and her children one negro woman named Sylvia, under the trusts and Conditons of the 3rd, 4th, and 5th items of this Will.

Item 8th. I also give and bequeath unto Thomas E. Williamson as trustee and in trust for the children of my daughter Mary Hinsley, departed life, two lots of land in the Cherokee Territory for which I have plats and grants, which said lots of land I wish said trustee to sell when he thinks most prudent and the proceeds of such sale equally divided amongst said children then in life.

Item 9th. I also give and bequeath unto Thomas E. Williamson as trustee and in trust for James and Alethia Huff, children of my son Wiley Huff, departed life, one negro boy named Willis to be managed by said trustee as he may think most conducive to the interests of said children, but not to go into their possession until they arrive of age.

Item 10th. I have given to my son Valentine Huff two negroes, Viz, Ben a boy and Julia a girl yet in my possession to which he has a Bill of Sale, and which I hereby confirm as his share of my Estate.

Item 11th. I also give and bequeath unto Thomas E.Williamson as trustee and in trust for my son Green Huff two negroes, Frank and Allen, for the purpose of aiding in cultivating the plantation whereon I now live and supporting my two daughters, Elizabeth and Sarah, and in case my son Green should marry, the title to vest in his children (to said negroes) free from this trust.

Item 12th. I also give and bequeath unto my daughter Elizabeth Huff one negro boy Sam or Samuel and also the promissory notes in my possession payable to her - to her and her heirs forever.

Item 13th. I also give and bequeath unto my daughter Sarah Huff one negro boy Moses and one negro girl Mariah to her and her heirs forever.

Item 14th. I also give to my two daughters Elizabeth and Sarah Huff all my household and kitchen furniture including beds and everything appertaining to the houses, with the stock of all descriptions, with the use of the plantation whereon I now live, and plantation tools with this provision, that my Son Green is to have his proportionable part of the products of said farm, so long as he remains with my said two daughters, and after the death of my two daughters the plantation is to go to the heirs of my son Green in the same manner as under the trusts and conditions that govern the two negroes Frank and Allen.

Item 15th. Anything not herein bequeathed, I give to my daughter Sarah to dispose of as she pleases.

Item 16th. I hereby constitute and appoint Thomas E. Williamson Executor to this my last Will and Testament, desiring them to divide my Estate as before specified without appraisement.
