State of Georgia} This indenture made this fifteenth -day August in the year of our Lord one thousand eight hundred and sixty three Between William L. Mitchell, executor of Robert Taylor of the county of Clarke and State aforesaid of the first part, and Aley Gann of the other part witnesseth, that the said William L. Mitchell Executor as aforesaid, in obedience to a decree of the Superior Court of Clark County Georgia at August term 1860, and after due notice as to time and place and in terms of said decree, exposed to sale at public outcry, that part of the real estate of said Robert Taylor hereinafter more particularly described, and the same sum knocked off to the said Aley Gann the highest and best bidder. And the said William L. Mitchell Executor as aforesaid in the consideration of the sum of eleven hundred dollars she did to him aforesaid in hand paid, the receipt whereof is hereby acknowledged hath granted, bargained, sold, and conveyed, and by these presents doth grant bargain, sell, and convey unto the said Aley Gann in fee simple all that tract of land in the county of Clark and state aforesaid, known and distinguished as the Aley Gann place containing about three hundred and thirty acres on the Middle River, but __________ not guaranteed being the same tract of land sold by said Aley Gann and conveyed by her to Robert Taylor in his life time. To have and to hold the same with all the rights, privileges, and appurtenances thereof to him and his heirs forever. And the said William L. Mitchell Executor as aforesaid covenants that he has finished said decree in bringing said land to sale.
