Georgia             } This indenture made this twenty eighth day of January in the year
Clarke County  } of our Lord one thousand, eight hundred & sixty between Joseph H. Donahoo Executor of James Donahoo deceased of the County of Clarke & State of Georgia on the one part and Thomas G. Macon Trustee of his wife Alethea Macon of the other part. Witnesseth that the said Joseph H. Donahoo Executor of James Donahoo deceased as aforesaid for & in consideration of the sum of twenty seven hundred & forty six Dollars & twenty cents to him in hand paid at & before the sealing & delivery of these presents, the receipt whereof is hereby acknowledged hath granted, bargained, sold & conveyed & do by these presents grant, bargain, sell & convey unto the said Thomas G. Macon, Trustee of his wife Alethea J. Macon his heir & assigns all that tract or parcel of land situate lying & being in the county of Clarke on Shoal Creek - said Creek running through said tract Containing four hundred & ninety six acres being the entire tract of land owned & upon which the said James Donahoo deceased formerly adjoining Capt John Deane Joseph J. Marton, Puryear & others, said tract having been legally advertised was exposed to sale at public outcry-before the court house door in the town of Watkinsville on the first Tuesday in November 1859 by the acre. East side of creek two hundred & twenty two acres at five dollars & five cents per acre, west side of creek two hundred & seventy four acres at five dollars & eighty five cents per acre making the above stated sum of twenty seven hundred & forty six dollars & no cents.

To have and to hold said tract or parcel of land unto the said Thomas G. Macon, Trustee as aforesaid his heirs & assigns together with all & singular the rights members & appurtenances thereof to the same in any manner belonging to his & their own proper use benefit & behalf forever in fee simple. And the said Joseph H. Donahoo Executor as aforesaid for himself, his heirs, executors & administrators, the said bargained premises unto the said Thomas G. Macon trustee as aforesaid his heirs & assigns will warrant & forever defend the right & title thereof against themselves & against the claim of all other persons whatever. In witness whereof the said Joseph H. Donahoo hath hereunto set his hand & seal the day & year first above written.
